Disclaimer & Limitation of Liability

The following disclaimer sets out the limits of Sarthi Associates' ("Sarthi") responsibility in respect of the Platform, our staffing engagements and our Engineering Consultancy services (including Thermal Power Plant, C&I, mechanical overhauling, calibration and loop-checking work).

1. General disclaimer

1.1 The Platform, its content and its services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

1.2 Sarthi does not guarantee (a) uninterrupted or error-free access, (b) that the Platform will meet your specific requirements, (c) the accuracy of any job listing, salary insight, worker profile, or third-party content, or (d) any specific employment or hiring outcome.

2. Role of Sarthi in staffing engagements

2.1 Sarthi is a connector and facilitator between candidates and Recruiters. Unless we have separately agreed in writing to act as a staffing employer of record, we do not enter into an employer-employee relationship with candidates who are hired through the Platform.

2.2 The hiring Recruiter alone is responsible for background verification, employment contracts, salary payment, statutory compliance (PF, ESI, gratuity, minimum wage), site safety, insurance and workmen's compensation.

2.3 Where Sarthi supplies manpower under a specific Manpower Deployment Agreement, the terms of that agreement — including safety, PPE, insurance and indemnity — override this general disclaimer to the extent of any inconsistency.

3. Engineering Consultancy — additional limitations

3.1 Engineering Consultancy engagements (Thermal Power Plant design/testing/commissioning, MOV & POV overhauling, switchyard maintenance, relay testing, calibration of transmitters, loop checking on DCS/PLC systems, elevator/lift maintenance, HT/LT motor overhauling and related services — "Services") are technical in nature and carry inherent industrial risks.

3.2 Our consultants provide advice, testing and commissioning support in good faith based on information supplied by the client and standard engineering practice. Ultimate responsibility for site safety, permit-to-work, isolation, energisation, load-test, hydro-test, statutory approvals and operational sign-off rests with the client's owner/operator and its licensed engineers.

3.3 Sarthi shall not be liable for:

• 3.3.1 Consequential, indirect, incidental, punitive or exemplary damages including loss of production, plant downtime, revenue loss, loss of goodwill, contract loss or forced outage penalties
• 3.3.2 Damage arising from client instructions, defective equipment supplied by the client, latent site conditions, force majeure events, or the acts / omissions of the client's other contractors
• 3.3.3 Damage caused by continued operation of equipment after Sarthi has issued a defect report, non-conformance notice or "stop-work" recommendation
• 3.3.4 Third-party claims arising from the client's failure to obtain statutory approvals, environmental clearances, or valid worker insurance

3.4 In no event shall Sarthi's aggregate liability under any single Engineering Consultancy engagement exceed 100% of the fees actually received by Sarthi for that specific Statement of Work.

4. Industrial and site work — safety notice

4.1 Frontline trades (welding, rigging, scaffolding, T&D work, plumbing at height, electrical work above 1.1 kV, boiler-tube work, confined-space entry, chemical handling) involve significant safety risk.

4.2 Candidates deployed via Sarthi must observe all Personal Protective Equipment (PPE) requirements, follow the client's HSE (Health, Safety and Environment) protocols, and hold valid trade certifications where legally required.

4.3 Sarthi's role does not extend to on-site supervision unless explicitly contracted. The hosting Recruiter is the "principal employer" under the Contract Labour (Regulation and Abolition) Act 1970 and is responsible for workplace safety and statutory welfare.

5. Third-party content, links and integrations

5.1 The Platform may include links to third-party websites, plug-ins, ads (via Google AdSense) or services (Razorpay, Twilio, SendGrid, Emergent Storage, Google Analytics and AI providers). Their inclusion does not imply endorsement.

5.2 Sarthi is not responsible for the content, privacy practices, terms or availability of any third-party service. Your use of such services is governed by the third party's own terms.

6. AI-assisted features

6.1 Where the Platform surfaces AI-assisted features (resume screening suggestions, chat responses, generated cover letters), such outputs are computational suggestions only. They may be inaccurate, incomplete or biased.

6.2 Neither the candidate nor the Recruiter should rely solely on AI output for hiring, remuneration or disciplinary decisions. Human judgement is always required.

7. Salary insights & market data

7.1 Any median day-rate, salary chart, market insight or growth report published on the Platform is a statistical aggregate drawn from user-submitted data and is provided for informational purposes only.

7.2 Such data does not constitute a promise, commitment, offer or guarantee of any specific compensation.

8. Force majeure

8.1 Sarthi shall not be liable for any failure or delay caused by circumstances beyond our reasonable control — including but not limited to acts of God, natural disasters, epidemics, war, riot, government order, labour unrest, power failure, cyber-attack, internet outage or third-party service disruption.

9. Cap on aggregate liability

9.1 Subject to clauses 3.4 (Consultancy cap) and 2.3 (Manpower Deployment overrides), Sarthi's aggregate liability under or in connection with the Platform and these documents (Terms, Privacy Policy, Disclaimer) shall not, in any twelve-month period, exceed the total fees paid by you to Sarthi during that period, or INR 5,000, whichever is higher.

10. Indemnity by user

10.1 You agree to defend, indemnify and hold harmless Sarthi, its directors, officers, employees and affiliates against any claim, loss or expense (including reasonable legal fees) arising out of your breach of these documents, your violation of law or your infringement of any third-party right.

11. Governing law & jurisdiction

11.1 This Disclaimer is governed by the laws of India. Any dispute shall be subject to arbitration and the exclusive jurisdiction of the courts at Noida, Uttar Pradesh, as set out in clause 13 of our Terms of Service.
