Terms of Service

These Terms of Service ("Terms") govern your use of https://www.sarthiassociates.com and related applications operated by Sarthi Associates ("Sarthi", "we", "us"). By registering, accessing or using the Platform, you ("User", "you") agree to be bound by these Terms.

1. Eligibility

1.1 You must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872.

1.2 You must reside in India or possess valid authorisation to work in India.

1.3 Business partners, contractors, HR users and recruiters ("Recruiters") must additionally represent a lawfully registered Indian entity or be authorised agents of one.

2. Account registration

2.1 You must provide accurate, current and complete information during registration and keep it updated.

2.2 You are solely responsible for maintaining the confidentiality of your credentials and for all activities under your account.

2.3 We reserve the right to suspend or terminate accounts that appear inactive, fraudulent, or in violation of these Terms.

3. Categories of users & role obligations

3.1 Candidates (frontline workers)

  • 3.1.1 Must submit truthful skill, experience and identity information
  • 3.1.2 Must not impersonate another individual or fabricate certifications
  • 3.1.3 May apply to any open job listing without payment — the Platform is free for candidates

3.2 Recruiters & business partners

  • 3.2.1 Must post only genuine, lawful job opportunities in India
  • 3.2.2 Must not solicit payment from candidates for job placement in any form
  • 3.2.3 Must comply with the Contract Labour (Regulation and Abolition) Act 1970, Minimum Wages Act 1948, Payment of Wages Act 1936, Employees' Provident Funds Act 1952, ESI Act 1948 and any other applicable labour laws
  • 3.2.4 Must respect candidate privacy and use candidate data only for the intended recruitment purpose
  • 3.2.5 Must respond to applications within 30 days or explicitly close a listing

3.3 HR users

3.3.1 HR users act on behalf of an authorising Recruiter and are subject to clause 3.2 mutatis mutandis.

4. Prohibited conduct

You agree that you will NOT, and will not attempt to:

  • 4.1 Post or transmit any content that is unlawful, defamatory, obscene, or that promotes discrimination based on caste, religion, gender, disability or ethnicity
  • 4.2 Ask candidates for money, personal favours, or offer employment conditional on such demands
  • 4.3 Use the Platform for scraping, bulk-download of candidate data, or automated harvesting without express written permission
  • 4.4 Circumvent or attempt to circumvent authentication, rate-limiting, verification or payment controls
  • 4.5 Upload viruses, malware, or content infringing third-party intellectual property
  • 4.6 Impersonate any person or entity or falsely represent an affiliation with any organisation
  • 4.7 Use the Platform to organise strikes, boycotts or activity in violation of applicable Indian law

5. Premium plans, payments & refunds

5.1 Certain features (Premium Plans, Engineering Consultancy bookings, featured job posts) are paid.

5.2 Payments are processed by Razorpay Software Private Limited or such other PCI-DSS-compliant provider as we may engage. All amounts are in Indian Rupees (INR) inclusive of applicable GST.

5.3 Auto-renewal: Premium subscriptions renew automatically unless cancelled at least 24 hours before the renewal date via your dashboard.

5.4 Refunds: Refunds are considered on a case-by-case basis within 7 days of payment for material non-performance by Sarthi. Requests must be sent to contact@sarthiassociates.com with proof of payment.

5.5 Discount codes are non-transferable, single-use unless otherwise stated, and may be withdrawn without notice.

5.6 GST invoices are issued to the billing entity on file and can be downloaded from the Billing History page.

6. Engineering Consultancy services

6.1 Sarthi separately offers Engineering Consultancy for Thermal Power Plants, Control & Instrumentation (C&I), MOV/POV overhauling, calibration, loop checking and related services.

6.2 A consultancy booking is confirmed only on successful payment. Scope, deliverables and timelines are documented in the individual Statement of Work (SOW) sent post booking.

6.3 The Limitation of Liability in our Disclaimer applies in full to all consultancy engagements.

7. User-generated content

7.1 You grant Sarthi a non-exclusive, royalty-free, worldwide licence to display, host and distribute the content you upload to the Platform (profile info, resumes, job posts, reviews) for the purpose of operating the Platform.

7.2 You represent that you own or have obtained all necessary rights to the content you upload.

7.3 Ratings and reviews must reflect genuine experience. Fake or malicious reviews may be removed and the offending account terminated.

8. Third-party services & advertising

8.1 The Platform integrates trusted third-party services including Razorpay (payments), Twilio (SMS/WhatsApp/OTP), SendGrid (email), Google Analytics & Google AdSense (analytics + advertising), Emergent Storage (file storage), and AI providers (Anthropic, Google, OpenAI) for optional AI-assisted features.

8.2 We may display third-party advertisements. Providers such as Google AdSense may use cookies to serve personalised ads based on your visit to this and other websites. See our Cookie Policy and opt out of personalised ads via Google Ad Settings.

8.3 We may collaborate with external partners for AI resume screening, industrial certification bodies (NSDC, ITI institutes), and enterprise data-processing services. Necessary information may be shared with such partners; we do not sell your personal data. See clause 6 of our Privacy Policy.

8.4 By using the Platform you consent to our engagement of additional third-party partners for similar purposes as the platform evolves.

9. Intellectual property

9.1 All trademarks, logos, product names, page headers, custom graphics and button icons on the Platform are proprietary to Sarthi Associates. Unauthorised use is prohibited.

9.2 Nothing in these Terms grants you any right to use the Sarthi name or marks without prior written consent.

10. Suspension & termination

10.1 We may suspend or terminate your account with or without notice if we reasonably believe you have breached these Terms, engaged in fraud, or created legal or reputational risk for Sarthi.

10.2 You may delete your account at any time via your dashboard or by writing to us. Refer to our Privacy Policy for data retention post-deletion.

11. Disclaimer & limitation of liability

11.1 Please read our separate Disclaimer which forms an integral part of these Terms. Key highlights are reproduced below for convenience only.

11.2 The Platform is provided on an "as is" and "as available" basis. We do not guarantee employment, salary levels, hiring outcomes, or the accuracy of any information posted by candidates or Recruiters.

11.3 To the maximum extent permitted by law, Sarthi's aggregate liability arising out of or in connection with the Platform shall not exceed the amount paid by you to Sarthi in the twelve months preceding the event giving rise to the claim, or INR 5,000, whichever is higher.

12. Indemnity

12.1 You agree to indemnify and hold harmless Sarthi, its directors, officers and employees from any claim arising out of your breach of these Terms, your violation of applicable law, or your infringement of any third-party right.

13. Governing law & dispute resolution

13.1 These Terms shall be governed by and construed in accordance with the laws of India.

13.2 Any dispute, controversy or claim arising out of or relating to these Terms shall be finally settled by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by Sarthi. The seat and venue of arbitration shall be Noida, Uttar Pradesh, and proceedings shall be conducted in English.

13.3 Subject to the arbitration clause, the courts at Noida, Uttar Pradesh, India shall have exclusive jurisdiction.

14. Grievance Officer

15. Changes

15.1 We may modify these Terms at any time. The "Last updated" date reflects the current version. Material changes will be communicated by email or in-app notice. Continued use constitutes acceptance.
